45-8 ENERGY is a trading name used by 45-8 GROUP SAS.

2.Terms of use

Use of the Site implies full and unreserved acceptance of these terms of use. These terms may be amended or supplemented at any time; users of the Site are therefore invited to consult them regularly.

The Site is accessible at all times, except in the event of force majeure, scheduled or unscheduled downtime, or any other event linked to a technical failure or maintenance requirement. 45-8 GROUP SAS shall under no circumstances be held liable for such interruptions or their consequences for users.

3. Description of services provided

The purpose of the Site is to provide information about 45-8 ENERGY’s activities (exploration and production of helium and natural hydrogen).

All information on the Site is provided for guidance only, may be updated, and is not exhaustive. It is provided subject to any changes made since it was published online.

4. Intellectual property and infringement

45-8 GROUP SAS owns the intellectual property rights, or holds the rights of use, over all elements accessible on the Site, including text, images, graphics, logos, icons, videos and software.

Any reproduction, representation, modification, publication or adaptation of all or part of the Site’s elements, by any means or process, is prohibited without the prior written authorisation of 45-8 GROUP SAS.

Any unauthorised use of the Site or of any of its content will be regarded as an infringement and prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.

5. Protection of personal data

45-8 GROUP SAS attaches particular importance to respecting the privacy of Site users and undertakes to process their personal data in accordance with:

  • Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (the “GDPR”); and
  • French Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties, as amended (the “French Data Protection Act”).

45-8 GROUP SAS has not appointed a Data Protection Officer (DPO), as this is not mandatory given the nature and scale of the processing activities carried out. Any question relating to data protection may be sent to the address indicated in the Privacy Policy.

The Site uses cookies and trackers, in particular for audience measurement purposes. A consent management banner (CookieYes solution) allows each user to accept, refuse or configure non-essential cookies on their first visit, and to change this choice at any time.

8. Limitation of liability

45-8 GROUP SAS shall not be held liable for any direct or indirect damage caused to a user’s equipment when accessing the Site, resulting either from the use of equipment that does not meet the required specifications, or from the appearance of a bug or incompatibility.

45-8 GROUP SAS shall likewise not be held liable for any indirect damage (such as, for example, loss of business or loss of opportunity) resulting from use of the Site.

9. Applicable law and jurisdiction

This Legal Notice is governed by French law. In the event of a dispute, and in the absence of an amicable settlement, the dispute shall be brought before the competent French courts.
